This agreement describes provisions of access to semi-annual imagery data licensed by the State of California from the Hexagon Content Program.
By requesting access to the Hexagon High-Resolution Aerial Imagery Streaming Web Map Service provided by the State of California and made available through the National Tribal Geographic Information Support Center (NTGISC), you acknowledge the following terms of service. As the requester, you are an employee of a Tribal Government recognized by the State of California, as defined by the Judicial Branch of the State of California. https://courts.ca.gov/programs-initiatives/tribalstate-programs/california-tribal-communities
The use of the Hexagon High-Resolution Aerial Imagery Streaming Web Map Service is made possible through a Memorandum of Understanding (MOU) between the State of California Department of Technology (CADOT) and NTGISC, and is subject to all terms and conditions negotiated between CADOT and NTGISC.
• Usage: The data are available under a state and local government use license, including public educational institutions and California tribes.
• Public Sharing: You cannot create a public service for the purpose of sharing the imagery outside your organization, and it should not be indexed or searchable on its own outside of your organization. However, you may use the imagery within other public-facing applications as a basemap or other supporting data layer.
• High Volume Access and Machine Learning: The imagery may be used to generate derived products, including use in machine learning applications. High volume and machine learning applications should use different server endpoints that CDT can provide and are expected to respect server rate-limiting (returning HTTP 429). Private subcontractors of public entities may not use the data for ML purposes.
• Subcontractors: You may make the data available to active subcontractors – subcontractors must not retain access or keep content after contracts end.
• Duration: This agreement lasts as long as the State of California continues procuring imagery from Hexagon. License for products created is perpetual – e.g. static maps in publications may be used even if the State of California terminates its license with Hexagon.
• Imagery Credit: All publications that use this imagery can reference its use as: Hexagon Content Program, High Resolution California Imagery {year(s)}. https://contentprogram.hxdr.app/catalog. Accessed under subscription to the State of California.
• Responsibility: Users of the data within your organization must be made aware of the provisions of this agreement.
